Terms and Conditions

1. The Competition will run on www.farylmusic.com website
2. Closing date for entries is 30/04/09
3. The competition is open to all citizens of the UK and Republic of Ireland of any age and entrants under 13 must gain parental consent before entering, except employees of Universal Classics and Jazz, a division of Universal Music Operations Limited and their associated, affiliated or subsidiary companies, and their families, agents, or anyone connected with this Competition. Winners under the age of 18 years will require parental consent to attend the studio session and performance for Universal Classics and Jazz A&R and must be accompanied by a person aged 18 or over at such studio session and performance.
4. No purchase is necessary but entrants should be aware that they may be subject to local call charges depending on their own individual arrangements for Internet access.
5. An eligible entrant must be an individual resident in the UK or Republic of Ireland and must submit by uploading their video to www.farylmusic.com including their name, address and e-mail address. Entries may be rejected in the sole discretion of Universal Music, including for reasons of obscenity, defamation or invasion of privacy.
6. Universal Music will not be liable for any failure of receipt of entries. Universal Music takes no responsibility for any entries that are lost, delayed, illegible, corrupted, damaged, incomplete or otherwise invalid. Further, Universal Music will not be liable for technical, hardware, or software failures of any kind or lost or unavailable network connections which may limit or prohibit an eligible entrant's ability to participate in the Competition.
7. By entering and submitting a video (if applicable), all eligible entrants agree to abide by each and all of these General Rules, the Terms and Conditions and Terms of Use { http://www.farylmusic.com/terms-and-conditions} and the Security and Privacy Policy { http://umusic.co.uk/privacy.html } that govern www.farylmusic.com. If the entrant is under 18 years of age they must print a copy of all these terms and conditions for their parent or guardian to read and obtain their consent before entering the competition and submitting a video. If a winner is under the age of 18 years, they must provide a letter of consent signed by a parent or guardian confirming the parent or guardian's consent to the winner attending the Classical Brits, studio session and performance. If you do not agree to these Terms and Conditions or you are under 16 years of age, please refrain from submitting an entry and photograph to the competition.
8. Universal Music reserves the right, with or without cause, to exclude entrants and withhold prizes for violating any of these General Rules and the Terms and Conditions and Terms of Use. Universal Music reserves the right to amend these General Rules. Any amendments will be published on the Website.
9. All entries will become the property of Universal Music and will not be returned.
10. By submitting a video and any other materials (including the winners final recording as described in clause 13 below) (“the Materials”) with an entry the entrants agree to grant Universal Music a non-exclusive, fully paid and royalty free, sub-licensable and worldwide licence to use, edit, modify, display, publish, perform, reproduce, communicate, and distribute the Materials on or through the Website and through those websites to which the video is uploaded when entering the Competition. For the avoidance of doubt, all entrants agree to the free use of their names, photographs and general locations for publicity and news purposes during this and future promotions in any and all media by Universal Music or any associated or subsidiary company of the Universal Music Group of companies and Universal Music shall be entitled to display the Materials on the Website and through those websites to which the video is uploaded when entering the Competition. Universal Music shall not acquire any right, title or interest to the intellectual property rights in the Materials, except as provided in this clause. If a person does not wish to grant Universal Music such rights in the Materials then they should refrain from entering the competition. Also, by submitting the Materials with an entry, the entrant warrants that they are free to grant such rights in the Materials to Universal Music and agree to indemnify Universal Music in respect of any claims, damages and costs arising as a result of the entrant's breach of this warranty.
11. There are 2 parts to the competition. Entries will be judged by Universal Music and the winner will be able record their entry in a professional recording studio and to perform in front of Universal Music A&R representatives. The winner will be selected by Universal Music judges using the judging criteria of which entry they consider to be the best.
12. Universal Music will make the winner's recording available to stream and download free of charge to the consumer and the winner by entering this competition accepts the conditions set forth in clause 11 above.
13. Both Universal Music and winner acknowledge that neither party shall be entitled to commercially exploit the winner's recording in any way without the prior consent of the other party.
14. The winner will be given a pair of tickets to The Classical Brits and get the chance to meet Faryl.. No cash or prize alternative will be offered.
15. The winner will be notified by e-mail within one month of the closing date. All reasonable endeavours will be made to contact the winner during this time. If a winner cannot be contacted before this time on the mobile number or email address supplied by the entrant with their entry, the Universal Music reserves the right to select the entrant whose entry the Universal Music panel considered to be next best.
16. Entrants must be available during normal working hours of 9am to 5.30pm during the week of the studio session and performance. Universal Music will notify the winners of the date and time of the studio session and performance closer to the time.
17. The winner (and anyone accompanying winner) must arrange their own transport to the studio session and performance. Travel, accommodation and incidental expense including travel insurance are not included within the prize. The judges' decision is final and binding on the entrants. No correspondence will be entered into.
18. The judges reserve the right to not select an overall winner if none of the entries are deemed to be of high enough quality.
19. There is no cash or other alternative to the prizes stated and the prizes are not transferable and no part or parts of the prize may be substituted for other benefits, items or additions.
20. Uses of personal data received by Universal Music Operations Limited in the course of the competition are subject to the privacy policy found on the Website. The winner's name may be published on the Website.
21. By entering the competition all entrants are deemed to have accepted and be bound by these General Rules.
22. Universal Music reserves the right at any time to cancel, modify or supersede the competition (including altering prizes) if, in our sole discretion, a competition is not capable of being conducted as specified.
23. Nothing in these terms and conditions shall limit Universal Music's liability for death or personal injury caused by their employees or agents' negligence or for fraud.
24. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.
25. These terms and conditions shall be governed by English law and the courts of England and Wales shall have exclusive jurisdiction.
26. The promoter of this competition is Universal Music Operations Limited, a company registered in England and Wales with number 0950138 whose registered office is at 364-366 Kensington High Street, London W14 8NS.
